5. AI Content Disclaimer

You acknowledge that AI-generated content is provided for convenience and inspiration only.

You are responsible for all activities occurring under your account.

You agree to notify us immediately if you suspect unauthorized access to your account.

memories
uploaded photos
Quills posts
Quills replies
comments
personal content

By uploading content, you grant Momentiqa a limited, non-exclusive, worldwide license to store, process, display, transmit, and use such content solely for operating and improving the Services.

We do not claim ownership of your personal memories or journal content.

8. Community Features

Certain Services may allow users to publish content visible to other users.

Examples include:

Quills
comments
replies
future community features

You are solely responsible for content you choose to share publicly.

You may not post content that:

violates laws
infringes intellectual property rights
contains hate speech
contains harassment or abuse
contains malicious software
violates the rights of others

We reserve the right to remove content and suspend accounts that violate these rules.

9. Physical Products

Momentiqa may sell physical products through its website or other sales channels.

Product descriptions, images, pricing, availability, and specifications may change without notice.

We make reasonable efforts to accurately display our products but cannot guarantee that colors, packaging, or product appearance will exactly match what is displayed on your device.

Returns, refunds, exchanges, and shipping are governed by our applicable Refund Policy and Shipping Policy.

10. Orders and Payments

11. Subscriptions

Subscriptions purchased through Apple App Store are governed by Apple's billing terms and policies.

By purchasing a subscription:

You authorize recurring billing through Apple.
Your subscription automatically renews unless canceled before the renewal date.
Subscription management is available through your Apple ID settings.
Refund requests are handled according to Apple's policies.

Momentiqa does not directly process App Store subscription payments.

We reserve the right to modify subscription pricing and features in the future.

12. Intellectual Property

All content provided by Momentiqa, including but not limited to:

trademarks
logos
branding
software
designs
graphics
text
images

is owned by Eser Enterprise LLC or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, sell, or exploit any portion of the Services without our prior written permission.

13. Third-Party Services

Momentiqa may rely on third-party providers, including but not limited to:

Apple
Google
Shopify
Supabase
OpenAI
Amazon
analytics providers
payment providers

We are not responsible for the content, policies, or practices of third-party services.

Your use of third-party services may be subject to their own terms and privacy policies.

14. Account Deletion

You may delete your account at any time through the application settings or by contacting us.

Upon deletion:

personal information
journal entries
uploaded photos
memories
shopping list data
community content associated with your account

may be permanently removed, except where retention is required by law.

15. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, Momentiqa disclaims all warranties, express or implied, including warranties of:

uninterrupted availability
accuracy

We do not guarantee that the Services will always be available, secure, or error-free.

16. Limitation of Liability

To the maximum extent permitted by law, Eser Enterprise LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services.

Our total liability for any claim shall not exceed the greater of:

one hundred U.S. dollars (USD $100), or
the amount paid by you to Momentiqa during the twelve months preceding the claim.

You agree to indemnify and hold harmless Eser Enterprise LLC, its affiliates, officers, employees, contractors, and agents from any claims, liabilities, damages, losses, or expenses arising from:

your use of the Services
your violation of these Terms
your violation of any law
